Height Issues

THE first thing everyone immediately notices about Jason Moore when they meet him is his height.

 

He is a gentle giant, standing a towering 6 feet 5 inches tall in trainers.

 

That's why he is affectionately known to his best friend as 'The Big Fella'. Or, as Robert Darby called him, 'Lofty'.

 

And yet despite this (literally) outstanding feature, his height was never even referred to during the trial – not even by his own defence team, who sadly neglected to make this fundamental point during cross-examination of the prosecution's chief eye-witnesses, Abdul Ahmed (AA) and Sally Palmer (SP).

 

In his first police interview conducted on the same day of the incident, Ahmed referred to the stabber as being 'bulky' and 'fit'. He described him as "about 5ft 10ins tall".

 

Of the three men in the street at the time of the incident, Robert Darby, ***** and Paul Hunt, the witness stated that the tallest of the trio (Darby) was 6ft.

 

At no stage whatsoever did he describe anyone standing 6ft 5ins tall.

 

How did Ahmed fail to notice the big height difference of FIVE INCHES when compared to the above named three?

Now we'll examine how passer-by Ahmed viewed the three men he recalled seeing on Perth Road.

But first you need to consider our strongly-held theory, supported by the reinvestigation, that was not explored either during the trial or at Jason Moore's Appeal. 

 

Incredulously, Darby's friend, Paul Hunt, expects everyone to believe that he slept through the whole violent incident, with the main protagonists screaming and swearing at each other just a few feet away from him. He claims he never left the passenger seat of Darby's black BMW while it was stationary in Perth Road. What utter nonsense.

 

Before reading what Abdul Ahmed thought he saw, it is crucial to bear in mind we are now convinced that not only did Hunt actually see EVERYTHING as it happened, he also got OUT of the car while the incident was in progress - probably to try and act as peacemaker between Darby and ***** as they were about to physically clash.

Hunt knew *****, although he didn't know Moore and had never met him.

***** drove his silver BMW 6 Series Cabriolet to the scene, with Moore in the passenger seat. ***** parked his car against the nearside kerb, on the left just before The Valentine pub.

OK, so let's now examine Abdul Ahmed's (AA) various witness statements and trial testimony (his comments and responses appear below in light type)

 

AA's Witness Interview – Ilford Police Station, August 24, 2005

Interview conducted by DC Neil Bartle and TDC Kirk Lewin

 

Driver of black BMW (Darby) 6'0, 30-35, skinny, smart appearance, white shirt, black trousers.

 

Stabber (*****) 5'10, 30-40, bulky – he was strong, physically fit, dark ​short hair (number 2 length), navy or royal blue jacket. Bulkiness. Black normal, short hair.

 

The other person (Hunt), shorter than the knifeman 5'6, 30-35, normal build, not fit, not strong, not skinny. Hair was like your hair but fluffy, dark brown like big hair, but not short, longer on top.

 

 

AA's Witness Statement – August 24, 2005

 

Male from black BMW (Darby) 6'0, 30-35, tall,  white shirt, skinny build.

 

Person nearest to him, the one with the knife (*****) Taller than me, 30-40, dark, short hair. Royal blue jacket. Physically fit in appearance.

 

The furthest person from him – other side of silver car (Hunt) 5'6 , 30-35, shorter. Thick brown hair but not long, sticking up as if uncombed, a couple of inches in thickness from his head. Normal build – not skinny, not fat.

Man with the knife (*****) How much taller than you was man with knife? I don't know. Yes, could be he is taller than me – me being 5'6. Maybe he was 6'0.  

 

Shorter man (Hunt) Confirms height of 5'6.

Man stabbed (Darby)​ Confirms height of 6'0.

Driver of silver BMW Can't remember hair but guesses "short hair".

Driver Not stocky, was about my size, slightly slimmer than me.

AA's Trial Court Transcript – November 21, 2013

 

Ahmed's responses (in light type) to Simon Dennison QC, for the Crown Prosecution Service (CPS), and David Howker QC, Jason's defence barrister.

 

DENNISON (CPS) Driver of the black BMW (Darby), quite tall, 6'0, skinny build, 30-35.

 

DENNISON Person with knife (*****), passenger of the silver car . . . dark blue jacket, black hair. He was fit, bulky fit, tall, aged 30-40.

 

DENNISON Other man from silver car, driver, short man about 5'0, my height, not a big man, average. Thick, brown hair – not long, a couple of inches from his head – sticking up and uncombed. Aged 30-35.

 

HOWKER (Jason's QC) The passenger: taller, fit in appearance, short dark hair (number 2 cut), normal, he has got black hair, normal short hair. It wasn't long – not shaved, but a little longer.

 

HOWKER Driver (Hunt), fluffy hair, big hair, short that came up to his collar, but longer on top.

 

HOWKER Driver of the silver car (Hunt): "You said your height, about 5'6, normal build, thick brown hair". Howker then goes over description Ahmed gave in interview and he agrees. 

 

So it is evident from all his various descriptions of the people at the crime scene that Abdul Ahmed never saw Jason Moore there at any time.

 

He didn't see him during the trial either, because he gave evidence from behind a screen.

 

If Jason Moore, some 10 or 11 INCHES TALLER than Ahmed, was stood in front of him today, we seriously doubt that the witness the CPS relied on to such a huge extent would still think Moore was the stabber . . .
